Cancellation of driving offence

If a person drives on a public road after their driver's licence has been cancelled by Transport for NSW, they are guilty of driving while disqualified. The penalty a person receives for this offence will depend on whether it is the first or second offence of this nature within five years. The maximum penalty is a fine of $3,300, imprisonment for up to 12 months and disqualification from driving for up to 12 months.

Continuing to drive after being disqualified

If a person drives on a public road after their driver's licence has been cancelled by the court, they are guilty of continuing to drive after being disqualified. For a first offence, the person faces a fine of up to $3,300 and up to six months in prison. For a second or subsequent offence, the person may be fined up to $5,500 and imprisoned for up to one year.

Driving after license suspension

If a person drives on a public road after their licence has been suspended by Transport for NSW, they will be charged with the offence of driving while suspended. A person may be fined up to $3,300 for this offence, sentenced to up to six months in prison for a first offence and up to 12 months in prison for a second or subsequent offence.
